
What is Court Supervision and Am I Eligible for It?
Court Supervision is when a Court sets a period of time where you will need to comply with the Court’s conditions such as not violating any traffic offenses. In other words, it a deferment of a conviction. Court Supervision could be as long as 24 months or as short as 1 month. If you comply with the Court’s conditions during that period of time, then your case (traffic ticket) will be dismissed without a conviction being entered on your public driving record. That in turn prevents employers and insurance companies from viewing the traffic violation on your public driving record. Court Supervision can also prevent you from having your driver’s license suspended if you have other convictions on your driving record or if you are cited with a certain offense that mandates an automatic suspension upon a conviction.
Not everyone is eligible for Court Supervision. There are numerous reasons why you may not be eligible such as already being placed on Court Supervision twice during a 12-month period or committing an offense that does not allow for placement of Court Supervision. Some of those offenses include speeding in a school zone, passing and overtaking a parked school bus and a second offense of operating a vehicle without insurance. A conviction on operating a vehicle without insurance or passing and overtaking a parked school bus will lead to an automatic suspension of your driver’s license. A conviction on an offense of speeding in a school zone will lead to having points assessed against your license. That could mean your driver’s license being suspended depending on your record. Court Supervision could be denied due to a poor driving record as well.
If you already are under Court Supervision for another traffic offense, then the prosecutor for that particular offense may be able to vacate that Supervision and have a conviction entered due to you committing a new traffic offense. If you happen to be a truck driver with a CDL license and you have been issued a traffic moving violation, then Court Supervision will be meaningless and the violation can still lead to your CDL license being suspended.
